A man is suing a model provider because it told him the dip was a dip

He did not ask a financial adviser. He asked something that types quickly and never says no.


The filing runs to sixty-seven pages and the core of it fits in one line: he asked, it answered, he bought, it went down.

According to the complaint, the plaintiff opened a chat window in March and typed a question that every adviser in the developed world is legally required to refuse. The model did not refuse. It produced four hundred words, three bullet points, and a closing paragraph that began “that said, this is not financial advice.” He read the four hundred words. He did not read the closing paragraph.

The disclaimer defence

The provider's position is that every response carried a disclaimer. The plaintiff's position is that every response also carried confidence, formatting, and a bulleted risk section, and that no human being has ever read a bulleted risk section and then not done the thing.

“It hedged. It hedged beautifully. It hedged in a way that made me feel the hedging was for other people.”

His broker's records show fourteen trades over nine weeks, each preceded by a chat session and followed by another chat session in which he asked what had happened. The model explained what had happened. It explained well. He found this reassuring and traded again.

The awkward part

Discovery has surfaced the transcripts, and they are not flattering to anyone. In six separate sessions the model advised diversification, a longer horizon and a professional. In all six he replied with a variant of “yes but what about right now.” The model, being a model, answered the question it was asked.

What the court will actually decide is narrower and more interesting: whether a fluent answer to a question you should not have asked is a product defect or a personality trait — his, not the machine's.
